Now that the wonders and joys of Christmas are behind us, many of us are now planning our New Years Eve celebration.

MORTGAGE FORGIVENESS ACT SIGNED INTO LAW

 

 

                   

Thursday, December 19th, President Bush signed H.R. 3648, The Mortgage Forgiveness Act of 2007, into law, sparing homeowners the tax burden associated with canceled mortgage debt.

 

Prior to this action, forgiven mortgage debt due to foreclosure, short sale, or deed in lieu of foreclosure, was considered taxable income. The new law, however, temporarily waives these taxes for debts forgiven (as high as 35%) from the beginning of 2007 to the end of 2009. The bill also extends the tax deduction for mortgage insurance premiums through 2014.

 

"This is going to make a happy holiday for many homeowners," President Bush said yesterday before signing the bill in to law. During the press conference he added the following:

 

"When you're worried about making your payments, higher taxes are the last thing you need to worry about. So this bill will create a three-year window for homeowners to refinance their mortgage and pay no taxes on any debt forgiveness that they receive. And it's a really good piece of legislation. The provision will increase the incentive for borrowers and lenders to work together to refinance loans – and it will allow American families to secure lower mortgage payments without facing higher taxes."

 

"There's more work to be done," Bush added, saying that Congress needs to pass legislation to strengthen Freddie Mac and Fannie Mae, to modernize FHA, and to allow the government to issue tax-exempt bonds for refinancing existing home loans.

 

The three major points of hits bill are:

 

·         Elimination of the “phantom tax” on foreclosures, short sales or other discharges of debt on a primary residence.  Consider this scenario:  A property is worth $250,000, and the mortgage balance is $300,000.  Under the old rules, if a lender forgave the $50k difference as part of a foreclosure, short sale, refinance or loan modification, the borrower had to claim the $50k as income and pay federal income taxes on that amount.  The new law eliminates this “phantom tax”, and the forgiven debt is no longer treated as taxable income to the borrower as long as certain requirements are met, such as the discharged mortgage balance must be on the taxpayer’s principal residence.

·         The tax deduction for mortgage insurance premiums is now extended until December 31, 2010 instead of expiring at the end of 2007.  The same rules apply as before in terms of the income limitations etc., and these rules are covered in the taxation section of the CMPS curriculum.

·         The capital gains exclusion is now $500,000 instead of $250,000 for an unmarried individual who sells their primary residence within 2 years of the time their spouse has died.  This new guideline applies to sales after December 31, 2007, and provides relief for widows and widowers by giving them a 2 year window from the time their spouse has died to sell their home and receive the $500,000 exclusion.  Of course, the same rules apply as before, where the individual(s) need to have lived in the home as their primary residence for 2 out of the last 5 years.

KEEP SAFE ON NEW YEAR'S EVE

 

 

Keeping safe on the roadways this Holiday season should be of the utmost importance to us all. The loss of a loved one at the hand of any traffic accident is tragic enough. 

 

I don't wish to bring up such unpleasant thoughts with the purpose of being morbid or negative. I bring this up because myself and several of my neighbors just experienced a fatal traffic accident just outside our neighborhood in Cherokee County on Christmas Eve. We were at home when all of a sudden we saw 3 News helicopters hovering in the air just outside our subdivision. It was not long afterwards that were notified that there had been a traffic accident that involved at least a double fatality.

 

With loved ones on the road at the time and other family members that live in the same vicinity (one of those being a 15 year old niece, turning 16 on New Year's Day and getting a great deal of driving time in right now),  the thought of any of them being in involved was a devastating thought, until we learned they were safe and not in the vicinity at the time of accident.

 

While we were fortunate to know that our loved ones were safe and sound, there were other families who were not so fortunate. They suffered the loss of a loved one on Christmas Eve. While I did not know either of the victims, I ask that we keep their families in our prayers the remainder of this Holiday season.

 

Please  do yourself a favor and remind your family and friends the importance of keeping safe this Holiday season and please review the below information....you never know, it just might save a life.

 

It goes without saying that New Year's Eve celebrations will invariably involve the consumption of alcohol. The common sense tactics include not drinking and driving. A driver has to be designated before having that first drink. Public transport is another safe option. If traveling in the back of a cab sounds unappealing then spend the night at the friends place.

 

If you are the host of the party please ensure that non alcoholic drinks are also served. A close friend could become a drunken lout; have the strength to refuse him/her a drink if he/she is finding it difficult to keep their emotions in check.

The onus of a safe party lies with the host. The host should know a few things about the liquor that is being served. Beer and wine are just as intoxicating as hard liquor. A 12-ounce can of beer, a five-ounce glass of wine, a 12-ounce wine cooler and an ounce and a half of liquor contain the same amount of alcohol. Mixers won't help dilute alcohol. Carbonated mixers like club soda or tonic water cause alcohol to be absorbed into a person's system more quickly. Fruit juice and other sweet mixers mask the taste of alcohol and may cause people to drink more. Fatty food provided with the alcohol will help because it will create a lining around the stomach that will prevent the alcohol from getting inside. This will ensure that the drinker is not overly dehydrated. There is a tendency to rely on someone’s physical appearance to determine his/her state of drunkenness, this must be avoided at all costs.

 

Fireworks, Pets and Children

A pet at home could be a problem because pets can easily get scared with the fireworks and large crowd. If enough pre – planning is done the pet can be desensitized to sound but if that is not possible the pet can be reassured by the tone of the owner’s voice time and again. Make sure that your pet has ID tags with current information on them, and that they are safely secured both before and through the holiday period. Candles, kids and pets don’t mix. Keep them away from each other.

 

 

GASOLINE $ENSE...TIPS FOR STRETCHING YOUR TANK

 

In terms of the economy and its effect on our daily lives, there is no hotter topic than the outrageous prices we are seeing at the pumps. The maddening part is as consumers, we have zero control over these inflated costs. To make matters worse, there's always that person who says something like, "You know, Europeans pay a lot more for gas than we do." That's true, but it doesn't make it any easier when we're reaching for our credit cards at the pump. The absolute worst part about high gas prices, however, is the notion of having no alternatives. Even a diligent hybrid owner has to make a trip to the gas station at some point, right?

 

So, now that you're feeling backed into a corner and completely depressed about the situation, what do you do? The answer is actually a simple one; cut down on the amount of gas you use. I realize it doesn't sound simple, but by changing just a few bad habits, any motorist can stretch a tank of gas no matter what type of car they drive.

 

Here are some tips that are sure to help.

 

Go Easy on the Pedals − Jackrabbit driving is a killer when it comes to burning fuel. Remember that slow and steady wins the race in more ways than one.

 

Avoid Long Idles − The bottom line is idling burns more gas than restarting an engine.
